1. Introduction
Welcome to The Education Story (“TES”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of TES websites, mobile applications, newsletters, services, and related offerings (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Who may use the Services
You must be at least the minimum legal age in your jurisdiction to form a binding contract (or have the consent of a parent or guardian) to use the Services. By using the Services you represent and warrant that you are eligible and that all information you provide is accurate.
3. Account registration
3.1. Account creation. Some parts of the Services require an account. You agree to provide accurate, complete, and up-to-date information and to maintain and promptly update your account information.
3.2. Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Immediately notify us at info@theeducationstory.com if you suspect unauthorized use of your account.
3.3. Account termination. You may delete or deactivate your account at any time by following the options available in your account settings or contacting us. We may suspend or terminate accounts that violate these Terms or for other legitimate business reasons.
4. User content and submissions
4.1. Your content. “User Content” means any content you submit, post, upload, or publish through the Services (e.g., resumes, articles, comments, images, videos, essays, messages).
4.2. License to TES. By submitting User Content you grant TES a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, perform, and display such content in connection with operating and promoting the Services. This license does not transfer ownership — you retain ownership of your User Content.
4.3. Responsibility. You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that you have all necessary rights and consents to grant the license above and that your User Content does not violate any law, these Terms, or third-party rights.
4.4. Removal. We may remove or refuse to publish User Content that violates these Terms or is unlawful, offensive, or harmful, at our discretion.
5. Acceptable use and prohibited activities
You agree not to use the Services to engage in activities including, but not limited to:
- Violating any applicable law, regulation, or third-party right.
- Posting content that is defamatory, obscene, pornographic, abusive, hateful, harassing, discriminatory or otherwise objectionable.
- Impersonating others, misrepresenting your affiliation, or providing false information.
- Uploading viruses, malware, or malicious code.
- Interfering with or disrupting the integrity or performance of the Services.
- Scraping, crawling, or harvesting content or user information without our prior written permission.
Violation of this Section may result in immediate suspension or termination of your access to the Services.
6. Intellectual property
6.1. TES content. All content provided by TES (including site design, text, graphics, logos, images, and software) is protected by copyright, trademark, and other intellectual property laws and is owned or controlled by TES or its licensors.
6.2. Limited license. Subject to your compliance with these Terms, TES grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.
6.3. Trademark use. You may not use TES trademarks, logos, or service marks without our prior written permission.
7. Payments, subscriptions and refunds (if applicable)
7.1. Paid Services. Certain features or services may require payment. When you enroll in paid Services, you agree to pay the fees indicated, plus applicable taxes.
7.2. Billing. Payments are processed through third-party payment processors. By making a payment you agree to the terms of the applicable payment processor.
7.3. Subscriptions. If you subscribe to recurring paid Services, your subscription will automatically renew until you cancel. You are responsible for cancellation prior to renewal to avoid charges.
7.4. Refunds. Our refund policy, if any, will be described on the applicable purchase page. In the absence of a stated refund policy, refunds are granted at TES’s sole discretion.
8. Third-party services and links
The Services may contain links to third-party websites, platforms, or services (including job boards, scholarship providers, payment gateways, and social networks). We do not control and are not responsible for third-party content, privacy practices, or terms. Links do not imply endorsement. Your interactions with third parties are solely between you and the third party.
9. Privacy
Use of personal information is governed by our Privacy Policy. By using the Services you consent to our collection and use of information as described in that policy.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. TES DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TES, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUES, DATA OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TES’S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO TES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED U.S. DOLLARS (USD $100) IF NO PAYMENTS HAVE BEEN MADE.
12. Indemnification
You agree to indemnify and hold TES and its affiliates, officers, directors, employees, and agents harmless from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of applicable law; (c) your User Content; or (d) your use of the Services.
13. Termination and suspension
We may suspend or terminate your access to the Services, in whole or in part, with or without notice, if you breach these Terms or for operational, security, legal, or business reasons. Upon termination, your right to use the Services will cease. Sections that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will survive.
14. Notices
We may provide notices by posting them on the Services or by sending an email to the address associated with your account. You accept electronic delivery of notices.
15. Changes to these Terms
We may modify these Terms from time to time. The revised Terms will include a new “Effective date”. If the changes are material, we will provide more prominent notice (for example, email notification or notice on the Services). Your continued use of the Services after the new Effective date constitutes acceptance of the updated Terms.
16. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
17. Miscellaneous
17.1. Entire agreement. These Terms, together with any documents expressly incorporated by reference (including our Privacy Policy), constitute the entire agreement between you and TES regarding the Services.
17.2. Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
17.3. Waiver. Failure to enforce any right or provision under these Terms will not constitute a waiver of such right or provision.
